Copypaint in Spain

In Spain, an artist continues to collect royalties from his art for 70 years. Every time his/hers work of art is resold the artist or his/hers heirs make 3% of the value of the painting (the formula is a bit more complicated than that). Considering that in Spain downloading movies and music for personal use is legal this law surprised me.

  1. No es de sorprender, se hace para que la protección del autor llegue a sus herederos, en el caso de artistas, interpretes y ejecutantes es de 50 años, más 20 tras su muerte.

    La legalidad de la copia privada es una excepción al derecho de los autores.

    Es complicado pero comprensible en un sistema que se centra en los primeros años del siglo XX cuando las entidades de gestión estaban adscritas al ministerio de educación y cultura.

  2. You continentals call this ‘droit de suite’. This law is actually extended now to cover all of Europe under an EU directive.
